“Frailty thy name is” – America

The world is paying inter alia for its hypocrisy. I always found it odd – to put it mildly – when the Russians are invited to participate in any “memorial” service for the victims of the Second World War. Yes, indeed, Russia suffered horrendously not only because of Adolf Hitler. Joseph Stalin and his cronies had a lot to do with it. Stalin literally annihilated the Red Army’s leadership before the war. It was Joseph Stalin’s agreement with The Third Reich [known as the ״Molotov Ribbentrop Agreement״] signed on 19th August 1939 that enabled Hitler to commence the attack on Poland, which brought about the war. It was the Red Army that attacked Poland from the East, while the Wehrmacht attacked from the West. How “comfortable” it is for the West to forget that the USSR commenced the war as Nazi Germany’s ally and held half of Poland, and ended the war as “a party” of the Allies controlling all of Poland. And, no, USSR did not change sides “voluntarily”. It was Adolf Hitler who “encouraged” the Russian to change sides when his army commenced “Unternehmen Barbarossa” on the 22nd June 1941. 

This rewriting of History, not by Pravda or Isvestia, but by the West, who gave legitimacy to Russia’s “contribution” to the victory over the Axis led by the Nasiz, is a demonstration that Right cannot fight Might. The Soviet Union – usually - manipulated the West to fight against cronies [Korea, Vietnam and the Vietcong, Cuba, etc.].

 

But following the end of the Second World War, all experts assumed that Europe would not see war. Almost as if reminiscent of “War to End all Wars” [as H. G. Wells’s book was titled] written after the First World War. Vladimir Putin led the KGB office in Berlin during the Cold War. The West was blind as to the personality, integrity and intentions of the Russian President. Such was the blindness that the New Iran Agreement “nominated” Russia as the trustee to keep and guard some of Iran’s uranium. This, after Russia offered Iran – in January, an alternate venue for energy, this with the knowledge of the USA.

 

The whole West is against Russia. All Western media is reporting about the invasion of Ukraine and condemning Russia. Sanctions are imposed, and President Biden assumes that this will stop Russia. It will not. Well, why did the West not stop Russia when its army invaded Crimea? I just love listening to Russia’s Foreign Minister, Sergey Lavrov, condemning the lack of democracy in Ukraine. The fact that Russia is the major supporter of Assad, or an ally of Iran, seems to be irrelevant. How similar his explanations are to those of Joseph Goebbels when “explaining” the problems of Germans in “Sudetland”. 

On 4th December 2021, the Washington Post published a news item, according to which, Russia is planning to attack Ukraine by the beginning of the year. So, because Ukraine did not made it yet to Nato [may I assume that the delay was initiated by someone in the West, so Nato will not be obligated to save Ukraine from what all intelligence agencies knew was coming], Putin  - who knows the mentality of the West much better than the West knows the mentality of Putin – was “safe”. All he needs is time. He knows that as long as the West does not initiate military actions against Russia, he has nothing to worry about. No economic sanctions will help. While Biden was announcing the almost meaningless [yes, meaningless] sanctions against Russia, the president of Pakistan, Arif Alvi paid a formal visit to Moscow. China will not condemn Moscow’s initiative. Many countries will continue normal relationships with Russia. Putin knows that in the near future, the West will “come down”. Frictions will deepen for one reason [energy] or another [wheat]. Like a person who was told he has cancer. He is shocked at the beginning but then goes on with normal life. So, will the West behave. 

And the Western Media is at fault as well. Why did all of them broadcast a statement and Q&R with Alexander Lukashenko, the president of Belarus? Did he have to add anything? Someone whose intellectual abilities reach the level of wood? Does he have any influence? Of course not. The Western media offers him recognition. That is all he needs. The fact remains that all the West’s efforts, the ‘blitz’ of condemnations, the sanctions, and the help that was offered to Ukraine did not have the expected results. Kyiv is devastated. A Pariah is winning against a hopeless West. And not for the first time. It is true that secret agencies annihilate enemies. USSR was known to kill critics of its leaders, even overseas. One of the more infamous “liquidations Russian style” outside the USSR was the killing of Leon Trotsky, who exiled himself from Russia to Coyaocan - Mexico. He was murdered there by NKVD’s agents on 20th August 1940. He was shot. 

But the murder of Alexander Litvinenko in November 2006 was not “just another liquidation” by Putin [He did use the “regular methods” many a time within Russia - the name of the Journalist Anna Politkovskaya murdered in 2006 comes to mind]. He created a precedent after World War 2.

Mr. Litvinenko was in the centre of London [a hotel in Grosvenor Square – adjacent to the US Embassy in London].  Putin’s agent  actually used a radioactive weapon to kill someone who became an English citizen. Many more could have been killed in case of an accident. Is any party in Russia facing the consequences of what might have caused a massive calamity in The Court of St. James? Did Her majesty’s government take any actions? No. A simple “no”. 

Yes, I know. Nazi Germany won at the outset of World War 2 and lost [once decided to invade Russia]. It was not economic sanctions and condemnations that brought victory. It was military might. Putin is no different. And for President Biden to make this stunning statement that the West will not fight the Russians in Ukraine, not even leaving Putin in doubt, is clumsiness at its highest degree. King Solomon wrote in Proverbs, “And good news makes the bones fat”. Jewish interpretation of this statement reads, “Nothing is marrier than clarifying of doubts”. Why did Biden clear the doubts? Why did he not – at least – have the Russians fear the unknown? And President Biden was not alone. Mr. James Heappey, the Minister of Armed Forces in Her Majesty’s Government made the same confirmation in the House of Common. Even a ”no-fly zone” was - according to him - an impossibility to enforce above Ukraine. The West is crippled. It will not even mislead Moscow as to its abilities. The fact that Russia made it to Kyiv, the fact that Putin will only fall by insiders [and he will] – not by the West - like Nikita Khrushchev on 14th October 1964 - is another demonstration of hopelessness.

 

America’s “successes” in foreign policy should always be taken into consideration. The happenings in Ukraine should serve as a major caveat to Israel, when the West signs the new agreement with Iran. It justifies the vote of no confidence in the USA by so many countries in the Arab world in general and the Middle East in particular. History testifies. Many agreements and unqualified statements made or signed by the USA were followed by embarrassing failures. North Korea is still around. Following the Nobel Peace Prize to Henry Kissinger and Le Duc Tho “for jointly having negotiated a cease-fire in Vietnam in 1973”, America literally fled through the roof of the American Embassy in Saigon; President Jimmy Carter’s assurances that “The Shah is a rock of stability, months before the latter fled Taharah; or president Biden’s assurances that Taliban will not take over Kabul. The rest is history. 

Let us think. Since 7th October 2023, a baby, a toddler, women, elderly are cutt off from the world. The US knows Hamas and Islamic Jihad committed war crimes is stunning levels. Yes, raping a woman and cutting her breast while she is still alive is a war crime. Behading heads and putting babies in ovens to be cooked are all war crimes.

The stunning decision of the Security Council for an immediate ceasefire is not only evil as it does not condition the cease-fire to the release of the kidnapped], it encourages Hamas to continue holding the hostages [well, they do need them for rape and other “benefits”], but it proves once again the accuracy to an answer to a previous Secretary of State’s question after signing the first agreement with Iran. “What do they think, we are Idiots”? The answer is, that I invite you to read your own history and make your own conclusions.

What does the West think will be the result of a cease-fire now. There were many cease-fires between Israel and Gaza. These ceasefires were always – but always -  breached by terrorists from Gaza who rocketed many and only areas concentrated with civilians. Is there anybody with a head on his shoulders who thinks that a cease-fire without annihilating Hamas will end differently? 

When Israel suffered from Hamas shelling of its south, The US and the UN did nothing. If we do not bring down Hamas, if we do not clean Gaza of these Gistapo-like people, what does the president of the US think will happen in the future if there is a cease-fire? Hamas will not attack Israel again? Islamic terror will cease in the US and Europe?

The West does not know how to handle terror groups, it does not know how to handle Iran, it does not know how to handle Russia, and it does not know how to handle China.

Iran fulls them all. Germany did not invade Austria “out of the bleu”.  There were “preperations”.  The Nazis in Austria before the “Anchluß Östrerreich” led by Arthur Seyss-Inquart.  Before the invasion of Czechoslovakia in March 1939, had emissaries escalate the tensions [Sudetenland]. Indeed in the last meeting of Emil Hacha, the Check President, with the leaders of Sudetenland before the invasion, the poor president put an empty white paper in front of the “representatives” and at the bottom of the page, his signature. Inviting them to write whatever they wanted. The “representatives” walked out of the room for "consultations", never to return].  

During the Cold War, Russia had emissaries do the “dirty work” fighting the West. The American Army lost blood in Korea, Vietnam, Cuba, etc. The Russians allowed North Korea and China to fight its battles in Korea, North Vietnam  and the Vietcong in Vietnam, Castro and his cronies in Cuba, and all terror organisations at the time, from the Japanese Red Army, the Italian Red Brigade, and  - of course -  all Arab terror organisation. USSR or Russia failed when they commenced direct fighting [Afganistan and Ukraine]. 

Iran adopts the same policy. The Houthis in Yemen, Shiites in Iraq, Hamas in Gaza, and Hezbollah in Lebanon. Fighting the proxy will not solve the problem. Iran is the target. If the Mullahs in Iran are brought down, there will be no support for terror organisations in the Middle East and no cells in Europe and the USA. 

The US always proved itself “unfortunate” in foreign policy. The difference is one. When the US makes such a mistake, it will suffer but survive. Israel might fall if we listen to the USA.

The short-sightedness of the West will not help. As broadcasted by BBC, many in London wish the city and the UK to be ruled by Sharia. Hamas, ISIS and other terror organisations are well-placed in Europe It is a tragedy that the world has such a short memory and zero imagination of how to solve the Gaza problem. Or the Iran ptoblem.

Every challenge to Israel will resurrect the spirit of Hamas. Even if Hamas is "gone", if this is followed immediately by an initiative to form Palestinian State, every Arab will understand that killing, raping and kidnapping is worth it. All will say that Hamas “gifted us” with a  Palestinian State . Hamas's way is the right way. One step forward to Islamic Europe.

בשעה שניהלו ראש ממשלת בריטניה נוויל צ'מברלין וראש ממשלת צרפת אדואר דאלאדיה את המשא ומתן לצורך מניעת המלחמה, שהסתיים בהסכם הטראגי הידוע בעגה ההיסטורית ״הסכם מינכן״ שנחתם ב 30 בספטמבר 1938 ידע אדולף היטלר כי ההסכם הזה אינו כי אם הולכת שלל. 

מי שפעל למען סיפוח אוסטריה לרייך השלישי, במרץ 1938 – בניגוד מפורש להסכמי ורסאי וסן ז׳רמן – היו שליחי הרייך השלישי, המפלגה הנאצית באוסטריה בהנהגתו של זייס אינקווארט. האלימות שהייתה המבוא לאיינשלוס נוהלה על ידי אוסטרים , לא גרמנים שרק דרבנו מאחור. כל התפתחות ״המעשייה״ של חבל הסודאטים, כיבושה של צ'כוסלובקיה וכמובן הפלישה לפולין היו תכנית מפורטת. היה זה וינסטון צ'רצ'יל של אחר שנות המלחמה קבע שכל מי שביקש לדעת את התפתחות ההיסטוריה מראש, כל שהיה עליו לעשות היה לקרוא את ספרו של אדולף היטלר ״מלחמתי״. 

האומה הבריטית למדה בדרך הכואבת כי המונח ״peace in our time״ שהשתמש בו ניוול צ'מברליין בנופפו בהסכם השלום לאחר נחיתתו בלונדון ממשאו למינכן, הבין שמדובר היה בהונאת ענק תחת שרביטו של איש הביניים בניטו מוסוליני, הדוצ'ה של איטליה. 

לא לחינם לא ימצאו רחובות על שם או אנדרטאות לזכרו של נוויל צ'מברליין באנגליה. אדולף היטלר השתמש באחרים לצורך גיבוש האימפריה שלו טרם שנלחם ישירות במזרח ובמערב. 

מי שלמד היטב את השיטה הגרמנית היו הרוסים. בכל שנות המלחמה הקרה כפי שהגדיר את התקופה ג׳ורג׳ אורוול במאמר שהתפרסם ב 1945. החל משנת 1945 ועד 1991 כמעט בכל מקום בו התעמתה ארצות הברית עם ברית המועצות נשפך דם אמריקאי רב בעוד ברית המועצות משתמשת בשליחים. כך היה המצב ביוון, כך מלחמת קוריאה בא עשו צפון קוריאה וסין את מלאכתם של הרוסים כשפלשו לדרום ב 1950, פלישה שהתפתחה למלחמה שנמשכה שלוש שנים. כך היה בווייטנאם, כאשר צפון ווייטנאם והוייטקונג עשו מלאכתם של הרוסים, משבר הטילים בקובה ב 1962, התפתחותם של מפלגות קומוניסטיות שאיימו על המשטר הדמוקרטי במדינות מערב אירופה כמו איטליה וצרפת, ארגוני טרור שהתאמנו במחנות הפליטים של אש״ף בלבנון ומומנו על ידי ברית המועצות - כך הצבא האדום היפני, הבריגדות האדומות באיטליה, תנועת הטרור הבסקית בספרד, הIRA באירלנד ועוד. 

למעט בשני מקרים בהם הייתה רוסיה פעילה קרוב לבית וכשלה – אפגניסטאן ב1979, והמלחמה המשתוללת באוקראינה - רוסיה הייתה פעילה צבאית בהצלחה גם ״קרוב לבית״. גרמניה המזרחית 1953, הפלישה להונגריה 1956, והפלישה לצ׳כוסלובקיה בשנת 1968. 

מפלתה הפוליטית של רוסיה בפולין היא שהובילה בסופו של דבר לנפילת חומת ברלין (המהפכה שהובילה תנועת סולידריות בראשות לך ולאנסה, שלימים הפך לנשיא פולין).

העולם המערבי ככלל, העולם הערבי בצנעה, וישראל בראש גלי נלחמות בארגוני טרור המהווים שליחים. כל אותם ארגוני טרור, החמאס, החיזבאללה, הג׳יהאד האיסלמי והחוטים מיישמים ועושה דבריה של איראן העושה את דת האיסלאם קרדום לחפור בו. קשה מאוד לאנשים בקושי יודעים לקרוא ולכתוב להתמודד עם השקפת עולם דתית כפי שבא לידי ביטוי על ידי המולות באיראן. אבל לעולם המערבי אין סיכוי לנצח אם המלחמה תהא נגד עושי הדבר מטעם ולא נגד השולח. אמנם כן, ישראל מצליחה לעיתים לפגוע בראש עקרב זה או אחר שמקורו באיראן. אבל בכך לא סגי. היה זה שר החוץ של ארצות הברית, ג׳ון קרי, שנשאל לאחר החתימה על ההסכם הראשון שנחתם - תחת חסותו המפוקפקת - עם איראן לעניין אי הפצתו של הנשק הגרעיני לשאלתו של עיתונאי שהכעיסה את מזכיר המדינה. שכך ענה ״we are not idiots״ והאמת היא, you are. 

בדיוק כפי שנהגה גרמניה ערב מלחמת העולם השנייה, בדיוק כפי שפעלה ברית המועצות במהלך המלחמה הקרה – גם באירופה המערבית – האירנים שותלים תאים בערים החשובות באירופה [עשרות בלונדון, מאות בכל רחבי אנגליה, אוסטריה, שוודיה. צרפת בכלל נמצאת על צומת הדרכים המאיימת ביותר בהיסטוריה החדשה שלה. כפי קביעתו של ההיסטוריון הבריטי Paul Johnson במאמר שפרסם כבר לפני שנים בביטאון Spectator האנגלי – בשנת 2043, תהא צרפת המדינה הראשונה במערב אירופה עם רוב מוסלמי. היום, השם הנפוץ ביותר שמוענק לילדים בבלגיה הינו מוחמד]

רוב פעולות הטרור בשנים האחרונות באנגליה, צרפת, אוסטריה, ספרד, דנמרק, גרמניה הודו, אינדונזיה, פיליפינים, סרי לנקה, מקורו ״שיעי״. אצבע ארוכה של איראן. אי אפשר להילחם במקק או שניים ולפתור כך את הבעיה של המקקים. את מלחמת העולם הזו המתרגשת עלינו להילחם מול האויב היחידי שהבסתו הינה חניקת כל פעולות הטרור. כשנפלה ברית המועצות, נדמו פעולות הטרור של הבריגדות האדומות באיטליה [לא לפני שחטפו ורצחו ראש ממשלה לשעבר – אלדו מורו – בשנת 1978], של הבסקים ועוד.

על פי השבועון הכלכלי Forbs,   המורדים החות׳ים [אנצאר אללה] מחזיקים בהון אדיר של 2 מליארד דולר. החיזבאללה ב1.2 מיליארד דולר, בנוסף לאחזקות של ״חברת הבת״ שלו כתאאב חיזבאללה – הפועלת בעירק וסוריה. הטליבאן החזיק בהון של 2.5 מיליארד דולר, חמס מחזיק בהון של 500 מיליון דולר [מעבר להון האישי של מנהיגיו].

מספר המחבלים הקשורים לארגונים אלה עולה – בסך הכל – על מאה אלף, מבלי להתייחס לחברים בתאים באירופה ובארצות הברית.

אירן נוהגת כגרמניה, אירן נוהגת כברית המועצות, והמערב נוהג כמערב. ללא שינוי. המאבק המזויין בים האדום, בעזה, פעולות הטרור הן המבוא. אירן מבקשת פשוט להקים את האימפריה המוסלמית מחדש, בדיוק כפי שרצתה גרמניה הנאצית, בדיוק כפי שאיפתו דהיום של ולדימיר פוטין. המתחרה הגדול של אירן שלעת הזאת משתף איתה פעולה עד שיידרשו להכריע מי באמת מוביל את האומה האסלאמית, הינו רג׳פ טאיפ ארדואן, המבקש להחזיר את הדרה של האימפריה העותומנית, תחת הנהגתו כסולטן.

המערב יכול להכריע את אירן או להיכנע לה. בדרכו העכשווית, בניסיונותיו להציל את חמס [בניגוד לשאיפת הרבה מנהיגים ערביים] מוכיח המערב את שהוכיח בעבר. הוא אינו יכול להם לדיקטטורים. צ׳רצ׳ל ורוזוולט [ואחריו טרומן] לא יכלו לסטאלין [חלוקת אירופה לאחר מלחמת העולם השנייה] , הארי טרומן נכשל במאבקו בקים איל סונג [קוריאה] ג׳ונסון וניכסון לא יכולים היו להו צ׳י מין [וייטנאם],ארצות הברית על שלל מנהיגיה לא יכלו לפידל קאסטרו, ועוד.

במקום לאיים על איראן חותמים איתה על הסכמים, בדיוק כפי שחתמו עם היטלר. אז כשטוען שר החוץ של ארצות הברית ״אנחנו לא מטומטמים״ הוא מעיד שהוא מטומטם, אבל ממש מטומטם.

אנחנו במבוא למלחמת עולם שלישית. הבעיה היא שהדמוקרטיות אינן מבינות את זה.

מעשה שהיה כך היה. ראש הממשלה לשעבר, מר אהוד אולמרט, לא פעם כבר הביע את סלידתו מהימין ממנו צמח, מראש הממשלה מר בנימין נתניהו לו היה שותף עשרות בשנים. הוא יודע ללמד חובה על ראש הממשלה בשל ״שחיתויות״ לקיים מה שנאמר ״כל הפוגם, במומו שלו הוא פוגם״.

אבל, מר אולמרט הגדיל לעשות.

אין ספק שנשיא טורכיה - או תורכייה בשמה החדש - הינו התומך השני הגדול ביותר של החמאס, לאחר שליטיה של איראן. הוא תומך בהם יותר מאשר רוסיה, הוא מאשים את ישראל בפשעי מלחמה [זה מצמרר כמעט כמו אותה ועידה מוסלמית שנערכה לאחר פרוץ הקרבות בעזה, בריאד בירת סעודיה, שם, הנואם המרכזי בשאלת פשעי המלחמה של ישראל, היה לא אחר מאשר בשאר אסאד. [ככה זה עם חוש ההומור הערבי]. הוא אוייב, הגם שאין הוא משתמש בכלי נשק צבאיים.

הולך ראש ממשלת ישראל לשעבר, מדינה המותקפת על ידי אותו איש רע - רג׳יפ ארדואן - ושם, בראיון לתחנת טלוויזיה תורכית, יודע מר אולמרט להכריז ״בן גביר וחביריו רוצחים ... אני קורא להם אוייבים, אני אומר שהם שוחטים, שהם הורגים, הם רוצחים הם מחבלים״.

נניח לשאלה האם נטרפה דעתו של מר אולמרט [אני באמת ובתמים חושב שכן]. ראשית, כיצד מעז ראש ממשלה לשעבר להתראיין לתחנת טלויזיה של אוייב? הוא יודע שהתחנה נשלטת על ידי השלטון. הוא חשב שעשה טוב לישראל? אם יחשוב כך אני אקרא לו שקרן.

ואני חושב שראיון כזה, מלל כזה, האשמות חסרות שחר כאלו, היסטריה של אמירות, בתקופה כזאת היא בגידה במדינה. בגידה של ממש.

לו אני בן גביר - ואיני מחסידיו - הייתי מגיש תלונה במשטרה נגד אולמרט. שיחזור לבית הסהר. הוא ירגיש בבית.

Who are you Mr. Guterres?

Indeed, many politicians make stupid mistakes. Many make stunning statements, and many retreats in an embarrassing and foolish manner. What happened with the Secretary General of the United Nations, Mr. Antonio Guterres, is not only an admission of dishonesty and cruelty but gross failure in his responsibility as the United Nations Secretary-General, which failure does not begin today. We all heard him loud and clear, and his ‘criticism of those who criticize him’ has no merit. How can you justify a remark like “Hamas Attacks on Israel did not happen in a vacuum”? Hitter did not come to be what he was “in a vacuum”. The Versailles agreements had contributed to his political rise. Does this justify him in any way? What would such a statement possibly mean but justifying the 21st-century Gestapo?

How odd it is that before it was disclosed that Israel had nothing to do with the tragedy in the Al Hali Hospital in Gaza, the UN called for a deep investigation. The BBC, the NY Times, and Sky News were all “singing” against Israel. Once it was cleared that it was an Islamic Jihad that caused the tragedy, all is good and forgotten. Yes, BBC and NY Times admitted to being wrong. Mr. Gutteres? He is too busy.

It is true. Hospitals are protected by international law. When did the Secretary-General condemn Hamas for using Hospitals to conceal rackets? 

The United Nations, many Western organizations, and governments have tried to support Gaza for many years. They have injected staggering amounts of money and, yes, allowed Qatar to bring in cash, which in normal countries, would never be legal but constitute a classic case of money laundering. And the UN? Nothing.

Those funds were supposed to have supported the building of hospitals, schools, and kindergartens to benefit the population of Gaza. UNWRA has a very central base in Gaza.

Yes, UNRWA – The United Nations Relief and Works Agency for Palestinian Refugees in The Near East [The only agency of its kind – no other groups of refugees are supported by a parallel organisation] with an annual budget of one Billion dollars – announced on17th October, that Hamas has stolen humanitarian aids – inclusive of fuel and medicine. We did not hear anything from the Secretary-General. BBC and Sky challenge Israel's “rights” not to allow fuel to Gaze. And Hamas? Stealing Fuel from UNRWA, so Israel should allow more fuel in? So, Hamas can steal more? So who is causing the suffering of the Gazans. Israel or Hamas? Who contributes to such suffering? Israel or the UN? History will judge the integrity of The Secretary-General. History does not lie. It will judge Mr. Guterres to condemnation. 

The Secretary-General knows very well that UNWRA is cooperating with Hamas and has many times turned a blind eye to the confiscation of assets from UNWRA for its own purposes. To the concealing of ammunition in Hospitals and schools administrated and financed by UNWRA. The Secretary-General knows Hamas denies any movements of Gazans to safety. Mr. Gutteres knows what the consequences of Hamas were winning the elections in Gaza in 2006. All was “well” until Hamas became politically stronger. PLO’s personnel in Gaza were pushed of buildings to their deaths, not before family members were brought to witness these executions.

As the Secretary General of the United Nations, Mr Guterres was responsible for supervising how the governing entity in Gaza spends the money it received. He did not. He and his associates knew very well what was done with the money. But they poured in more. The misery of the people of Gaza and Hamas’ ability to conduct the atrocities on the 7th of October rests on his shoulders. 

When the Secretary-General demands that Israel allow fuel to be allowed into Gaza, does he demand they return the fuel that Hamas stole? Did he ever think how Hamas semi-paid the Iranians for the massive number of rockets they have? For the tunnels preparing the attacks on Israel? Is he alarming the world to look out for the private army of Hizballah that has all its ammunition directed against Israel? When did he last mention the name Hizballah? When did he last refer to Hamas before October 7th? 

Gaza is an independent entity from Israel. Israel has no legal responsibility for the welfare of the citizens of Gaza, in as much that Thailand had no legal responsibility towards those Cambodians fleeing Pol Pot’s regime in what he called Democratic Kampuchea until 1979. Notwithstanding this, Israel, in a voluntary manner, provided water and electricity to Gaza. Many Gazans received medical help and treatment in Israeli hospitals. Many from Gaza came to work in Israel (and expressed their gratitude by spying on Israel for Hamas). All this is a major act of generosity on Israel’s part. Point to another country that does that to citizens of another entity who, for years, attacked that country with missiles targeting only civilians?

The only entities responsible for the Gazans’ misery are Hamas and the Ayatollahs in Teheran, whose only justifiable reason for existing is barbarism. Instead of distributing the funds to the citizenry, the money they received to create jobs to erect hospitals and schools are used to construct tunnels to attack Israel. Instead of giving money to the poor, the leaders of Hamas built themselves luxurious houses in Gaza and made sure to have comfortable residences outside of Gaza to send their wives and children. Khalid Mashal “eulogies” the death of children in Gaza from the safety of a five-star hotel in Doha. Ask him where the children are? No, not in Gaza. Where is Isamil Haniye? Travelling between two heavens. Istanbul and Doha. How many of his 13 children are in Gaza? None.

Beheading children, cutting open a pregnant woman, taking out the fetus and shooting it just for fun, burning entire families in their homes, kidnapping toddlers, the youngest, 9 months old, raping women and even bodies, and looting while conducting all these other SS atrocities, cannot be justified by any man unless he is evil. The justification offered by Mr. Guterres gave legitimacy to Gestapo-style attacks. To Nazi systems operated by ISIS-Hamas. 

I do not recall Mr. Guterres condemning or expressing embarrassment about his country’s history. As the Prime Minister of Portugal, I do not recall him being forced to support miserable African countries located a few miles away from Portugal in North Africa. For one reason or another, Mr. Guterres believes that only Israel must support its enemy. And we did. Notwithstanding years of rockets and terror, electricity and water were delivered to Gaza. Israeli hospitals catered to Gazan’s needs. The reciprocity? Beheading heads of babies and then calling the murderer’s father by mobile phone – not his, the baby’s mother, to proudly tell his father of what he did. After all, Atbach al Yehud 

The Secretary General of the United Nations dares to justify the Gestapo attitude. How can I think about this in any other manner but as cooperation and justification? The Secretary General of the United Nations has no morals. Not only because of what he said but because of what he did not do for years, allowing Hamas to devastate Gaza and Gazans. 

Let the Secretary-General, before resigning, and he should resign, assign a few hundred UN policemen located in Cyprus and wasting the world’s money for nothing – and I mean, nothing - since 1974 [when the last bullet was fired between Turks and Greeks in this small island] to an area on the seaside in Gaza, construct a city of tents only for women and children with temporary infrastructure - water, medicine and fuel that Hamas cannot touch. This is subject to Israeli investigators being allowed in this area to investigate each and every person about the Israeli kidnapped. Any woman who does not cooperate should be ousted from the “safe area”. All men would have to stay in Gaza and make up their minds. Fight the Hamas and save yourselves or fight Israel and be doomed. 

Israel does not have to save Gaza. The UN does. Israel is not responsible for the sufferings of Gazans. Secretary General Gutteres is.

First adorn yourself and only then adorn other

White House Urges Israeli Government to Respect Peaceful Protests. As the White House spokesman said yesterday: - “We urge authorities to protect and respect the right of peaceful assembly,” a spokesperson for the White House National Security Council said. This is a very moving, interesting, and important statement and as an Israeli, I value the care the United States is expressing to the freedom of speech in Israel. 

In Israel, during COVID, tens of thousands of people demonstrated against the Prime Minister every Saturday night. In the last few months, at the beginning, every Saturday night, and now every day, there have been massive demonstrations in Jerusalem, Tel Aviv and other cities in Israel for and against the new legislation. In both cases, the police are there to keep the peace and safety of the surroundings and the safety of the demonstrators themselves. Indeed, about fifteen people were injured altogether, but there was never any possibility of the demonstrations not taking place and the demonstrators’ safety being secured. 

Now, does the United States issue a similar statement regarding itself? Does the United States have such a record? IS the United States to issue an “opinion” about peaceful demonstrations”? Let us see… 

Following the George Floyd murder in 2020, demonstrations broke out all over the United States of America. Nineteen people were killed, at least 200 cities imposed curfew in early June 2020, and the National Guard was employed, with thousands of police officers injured. 14,000 were arrested. 

In 1992, riots known as the Rodney King riots broke out in Los Angeles. 63 people were killed, 2,383 wounded, and 12,000 arrested. Not to mention incidents like the Brianna Taylor case on March 13th, 2020. During the demonstrations in Louisville following the killing of Ms Taylor, two LMPO officers were shot. 

The demonstration in Atlanta following the shooting of Rayshard Brooks. During these protests, an 8-year-old girl was shot. 

The Kanosha unrest of 2020 resulted in 2 protestors being killed. The Walter Wallace riots of October 2020 resulted in 30 officers being injured. 

This is a very short list of recent years' demonstrations in the USA that ended differently than the demonstrations in Israel. This, not including other incidents around the USA where police killing individuals resulted in demonstrations which, although had no tragic death consequences, were violent and resulted in injury and the destruction of property. 

So, for the White House to offer such a caveat to Israel is a demonstration of an utter lack of integrity. The Jewish Talmud offers the following advice: - “First adorn yourself and only then adorn others”. 

If I had a choice to demonstrate in Jerusalem or New York, for my own safety, I would demonstrate in Jerusalem. Because here you do not pay a capital price for using the holly tool of democracy – the right to demonstrate.

We believe the White House statement is ill-intended, unnecessarily patronizing, and insulting to a stable democracy. Comparing the demonstrations in the United States and those in Israel, we believe the United States could learn a thing or two about exercising democracy and free speech in challenging times.

מה פירושה של ״הפיכה צבאית״? שימוש בכלי הנשק שיש לצבא על מנת לתפוס את השילטון, להפיל שילטון מתחרה, או לאכוף על השליט האזרחי מדיניות שהצבא חפץ ביקרה כך בעשרות מדינות ברחבי העולם. מוונצואלה עד תאילנד. שלל מדינות באפריקה או בעולם הערבי. בשנים עברו אף צלחה ידו של הצבא להפיל ממשלות בתורכיה, אך נכשל בניסיון להפיל את משטרו של רג׳פ טאיפ ארדוגן, ביולי 2016. מהפכה צבאית, הפלת השילטון על ידי הצבא, או אכיפה שאוכף הצבא על השילטון הקיים לאמץ מדיניות זו או אחרת, כוללת שני מרכיבים. קבוצה מוגדרת. הפועלת כנגד הסדר הקיים - לובשי המדים - והאלמנט השני הינו השימוש בעוצמה שיש לצבא - הווי אומר ארסנל הנשק.

ישראל בוויכוח פנימי נוקב. כבמדינה דמוקרטית, הכל חייבים וזכאים להשמיע קולם. ההפגנות הינן ערך קדוש. אבל חישבו רגע על אותם אנשי מילואים המבקשים שלא להתנדב לשרות הצבאי. רגע. אין הם מקיימים את האלמנט השני של המהפכה הצבאית? עשיית שימוש בנשק שהופקד לנאמנותם, על מנת להפיל את השילטון או לאכוף עליו לפעול על פי הבנתו של אותו ״מחרים״? 

אותם המתפארים במדיניות הלזו [אהוד ברח או אהוד אולמרט ואחרים] שכחתם את הביקורת שהטחתם באותם רבנים שפסקו לצאן מרעיתם לסרב פקודה בהידרשם לפנות יהודים ממעוז זה או ישוב אחר?

אז זו אינה הפיכה צבאית. זה בהחלט משיק לה. הלא כן?

שתיים הן, אותן קבעה כבוד היועצת המשפטית לממשלה במהלך ישיבת הממשלה. בשבוע שעבר.

 

 

האחד - באשר קיים ניגוד אינטרסים בין הממשלה ובין אותם המפגינים לה, אל לה לממשלה לקבוע ״הלכות״ או מדיניות לעניינם של אלו ההפגנות, או כפי מילותיה של הפרופסור גלי בהרב-מיארה, שכך, בין השאר קבעה: -  ״ מערכת אכיפת החוק מחויבת להפעיל את הסמכויות שנמסרו לה בדין, באופן מקצועי ועצמאי. עצמאות זו מהווה ערובה מרכזית לשמירת זכויות האדם. דווקא בעת מחאה נגד מדיניות הממשלה ושריה, על הממשלה להקפיד הקפדה יתרה להימנע מפעולות שיש בהן כדי להתפרש כניסיון להשפיע באופן לא לגיטימי על שיקול הדעת המקצועי של גורמי אכיפת החוק״. ובאשר – כך כבוד היועצת – ההפגנות הינן נגד הממשלה, ״התערבות הממשלה״ או קביעת מדיניות על ידי הממשלה, הינה פעולה על פי ניגוד אינטרסים. למד מכאן, אל לה לממשלה להתערב בדרך זו או אחרת בקביעת מדיניות כלפי ההפגנות.

לא, כבוד היועצת המשפטית לממשלה לא ציינה בהנחייתה המשפטית כי הפכה את הנחיית היועץ המשפטי לממשלה מר מני מזוז, ששימש בתפקיד בזמן ההתנתקות. ביום 27 מרץ, 2005 השתתף מר מזוז בישיבת ממשלה שדנה בהיערכות הממשלה להפגנות כנגד ההתנתקות. לא רק שהיועמ"ש, דאז לא התנגד, אלא אף התייצב בעצמו עם פרקליט המדינה ובכירים נוספים ממערכת האכיפה אצל ישיבת הממשלה  ודן בממשלה בדרכי אכיפת המחאות כולל הקמת יחידה חדשה ייעודית לכך במשרד המשפטים בתקצוב מיוחד של הממשלה. [זה היה מזוז. כבר אמרתי? שאיש לא יודע למה הסיר מעל עצמו את גלימת השופט טרם שיצא לגמלאות כבר הזכרתי? שקיפות בבית המשפט העליון מצאנו. נכון]?

ניגוד האינטרסים.  אז באם הממשלה מבקשת לצמצם את הגירעון התקציבי ומחליטה על הטלת מיסים. זה טוב לממשלה ורע למשלם המיסים.  אסור לממשלה לדון בכך? היועצת המשפטית עלולה לחשוב כי פעילות צבאית זו או אחרת יש בה על מנת להאדיר את שמה של הממשלה ו״להכות״ באופוזיציה״. אסור לה לממשלה לדון בכך כי מדובר בניגוד עניינים. אולי נהרהר קמעה על מקרה קיצוני מהעבר.  מבצע יונתן – מבצע מרהיב לשחרור נוסעי מטוס חברת התעופה איירפראנס ב4 יולי, 1976 מנמל התעופה הבינלאומי של אנטבה. אותה עת,   מעמדה הציבורי של ממשלת רבין לא הרקיע שחקים, אם לדבר בלשון המעטה [בבחירות שנערכו כשנה לאחר מיכן עלה הליכוד לשלטון בפעם הראשונה].  האם היה אסור על מר רבין ז״ל לקבל החלטה על המבצע כי היה בכך על מנת להאדיר את יוקרתה של הממשלה והשיקול היוקרתי ״מנוגד״ לשיקול המקצועי הטהור?  ברור שלא.  היכן הגבול? איזו ממשלה במדינה דמוקרטית אינה ״מטיבה״ עם העם לפני בחירות?

ואולי, ואולי  כבוד היועצת תיישם ״קשוט עצמך ואחר כך קשוט אחרים״?  הממשלה לא יכולה לדון בנושאי ההפגנות בשל ניגוד אינטרסים. והיועצת המשפטית?  שאלת הסבירות ומעמד היועץ המשפטי נוגע לה באופן אישי.  היא לא נגועה בניגוד אינטרסים?  לה מותר ולשרי הממשלה אסור?

ועוד, הביע היועצת המשפטית חששה בזו הלשון: - ״אני מקווה שהממשלה לא מצפה שמערכת אכיפת החוק תעמוד ב'מכסות' של מעצרים או כתבי אישום נגד המוחים״.  חשש אומלל. טוב היה לה לכבוד היועצת שלא להעלות טיעון מוזר זה מאשר להעלותו. מותר היה לעצור בנות 13 בתקופת ההתנתקות ללא זכות להיפגש עם ערכי דין. על כך לא שמענו מילה.  אבל הגברת בהרב ״חוששת״ על ״מכסות״ בהפגנות כנגד הממשלה. מילה שאיש לא רמז עליה, איש לא התייחס לכך, למעט היועצת, על מנת להשחיר פני אותם אליהם היא אמונה. 

ועוד, קבעה כבוד היועצת המשפטית לממשלה כי ״אין מחאה אפקטיבית בלי הפרעה לסדר״. אז לכבוד הזכות ל״הפרעה אפקטיבית״ של האחד״ אמור האחר לסבול? לא שמענו את קולה של כבוד היועצת במהלך הפגנות של החרדים עת שעטו סוסי המשטרה כלפי המפגינים.

לא. הגברת בהרב, אלו דברי הבל. אין בנמצא זכות דמוקרטית ללא מגבלות. הזכות להפגין -קדושה ככל שתהייה -  היא זכות שעל מנת ליישמה יש לשמור על תנאים אותם קבע המחוקק. זה  הורה כי על משטרת ישראל לקבוע [אה כן, לא הממשלה, המשטרה] תנאים לקיומה. שום הפגנה אינה יכולה לשתק מדינה. הזכות להפגין נדחית בפני סכנת חיים. המפגינים שחסמו גישות לבתי חולים או את הגישה לנמל התעופה הבינלאומי היחידי של ישראל, או מחר את צירי הרכבת,  עשו בניגוד לחוק ושללו ממני את זכותי כאזרח. על מה ולמה שומרת היועצת הנכבדה על כבודו של המפגין ולא על זכותי כאזרח שומר חוק?  על מה ולמה מבקשת היועצת את כבודו של המפר חוק ברגל גסה? על מה ולמה קובעת  היועצת המשפטית  כי ייצא חוטא נשכר.

על מנת לשמור על זכותו – הקדושה ללא ספק – של המפגין, יש להבטיח כי את זכותו זו כמו כל זכות אזרחית אחרת – יישם הוד מעלתו האזרח על פי ובגבלות החוק. הערתה האומללה של היועצת הינה איום על אושיות החוק הנרמס ברגל גסה.

לאחר שנבין מדוע בשל אותה שאלה, יועץ משפטי אחד התיר התערבות ממשלתית נגד הפגנות ואף שלילת זכויות אזרח, והאחר סירב, נוכל להבין האם במשפט עסקינן או בפוליטיקה. יבוא מזוז ויוכיח.

אני מסכים. אל לה לממשלה לנהוג בייעוץ המשפטי ״ברצותו אוחז וברצותו שילח״.  מינוי יועץ משפטי כyes man הינו אסון חוקתי. מאידך, הממשלה אינה יכולה לקבל ייעוץ משפטי ממי שאין לה אימון בו.  והיה ואיבד יועץ משפטי את אמונו של שולחו, יהא השולח רשאי להפסיק כהונתו.  ואולם לא השולח יהא רשאי לקבוע את מחליפו. תקום וועדה ציבורית נעדרת פוליטיקאים או שופטים שייקבעו מי יהא רשאי ומי הוא זה שיכנס בנעלי היועץ שאיבד אמונו.
